Access Problems in Scotland

BACKGROUND:

You may or not be aware that the Land Reform Act Scotland (2003) allows “the right to cross land” for recreational purposes.

BACKGROUND:

Unfortunately the Buccleuch Estate (near Musselburgh and Dalkeith) has chosen to start locking the public out! The public are no longer able to excercise their legal right to walk, cycle and enjoy this legally accessible estate as both main entrances with 6′ gates are now padlocked shut 24/7.

Furthermore, we have emails from East Lothian council asserting by the Land Manager that apparently they have ALWAYS charged at these entrances and are therefore locking these up now.  We’re sure that many of you can testify that these entrances have always been free and publicly accessible.

HYPOCRISY!

The Estate is owned by “Richard Walter John Montagu Douglas Scott, 10th Duke of Buccleuch and 12th Duke of Queensberry” in it’s entirety. What’s more you can visit ‘Dick’s website (http://www.buccleuch.com/about/duke-of-buccleuch-chairman) and find out he is chairman of the national trust for Scotland!

What does the national trust have to say about Outdoor Access? This article (http://www.scotland.gov.uk/Resource/0043/00432855.pdf) published by the trust itself asserts

“The National Trust for Scotland is a strong supporter of public access to land for recreation and
enjoyment. We know how important this is to the well-being of Scots and of visitors to Scotland and it
has been a driving force in the work of the Trust’s members and volunteers.”

So what we have here is the PRESIDENT OF THE NATIONAL TRUST going against the aims of the Charity by blocking access to his own property!

WHAT CAN WE DO?

Please visit the East Lothian council page on Outdoor Access: http://www.eastlothian.gov.uk/a_to_z/service/153/outdoor_access and send an email to the listed email address voicing your concern and dismay at Buccleuch estate is no longer accessible to the public.

Please raise awareness! More power to the people!

They know they are in the wrong.  Now they know we won’t rest until they stop.

A recent update from the Outdoor Access officer from the council tells us they have engaged their legal team so fingers crossed….
