Threats to Scottish Access?

Recent press reports have suggested that the owners of Ledgowan Estate in Wester Ross will be asking walkers for their name and addresses – and photographing them if they refuse to comply.

A report in the West Highland Free Press said residents in Achnasheen had been delivered letters saying that all walkers met on Ledgowan estate would be asked for contact details. If these are not given then staff are instructed to take photographs of the person and/or their vehicle.

Access problems are not new at Ledgowan and this is the latest in a number of tactics by the estate to discourage walkers from exercising their statutory rights of access.

The MCofS would like to remind members that you are not obliged to supply these details to anyone other than the police and, although estate staff are not necessarily breaking the law to take photographs of walkers, if you consider that you have been intimidated by any landowner then you should dial 101 and report the matter to the police.

Only in November, following reports of problems at Ledgowan and elsewhere, the MCofS and Ramblers Scotland issued advice on reporting intimidation to police.

    It’s gonna cost them an arm and a leg if they’re thinking of regularly turning up in court with photos of random walkers! But they are being pretty silly really – time for a mass trespass? I’ve heard folks on the forum threatening one I think…

    Point of fact what legal grounds do they have? They can snap people til they’re blue in the face but it doesn’t change the legislation.
